There's a thread at Eve-online about LV, FinFleet and me "pressing charges" against a character using name Stuffer Ninjapirate. 99% of the thread in question is bullshit. To clarify issue to alliance members I decided to make a little post here
1) It is true, that report of an offence has been made to local authorities
2) This has nothing to do with FinFleet
3) This has nothing to do with Lotka Volterra
4) This has nothing much to do with Eve-Online
The person using said alias in Eve-online gained membership of FinFleet around half a year ago. We suspected from day one that he was a spy and restricted he's access to information related to Eve-online and even gave some false information to him.
During he's membership FinFleet's parent community, FinNexus, became a legally reigstered association in Finland. A legally registered and legally liable association.
He was found copying messages from FinNexus (the association) private communications system, which you might call Forums, to another communications system. This is directly, straightly and without a doubt lined illegal in finnish legistlation. I would like to add, that this association consists of people that have nothing to do with Eve-online. Our forums have contact information for association people including real names, phone numbers and such. There are even bank account information.
Me, as a person who's been working for past 14 years with matters of telecommunications privacy and related laws, decided as an invidual person working as Server Administrator for associations servers, to see out of interest how a clearly stated law would apply in such a case. From me this took about 5 minutes time, and will never take any longer, as I have submitted all information that I've been asked from. Being criminal law and criminal investigation, it takes no further money, time or effort from me.
As further information, I copy/paste following old message from our forums:
Sähköisen viestinnän tietosuojalaki 16.6.2004/516
(Electronic communications privacy law 16.6.2004/515)
§ 5
One, who has received or other way gained a confidental message or recognization information, that is not intended for him, may not - without permission from all parties - say or use content of the message.
* That is little controversial, but basicly law defines:
§ 2 Määritelmät / Definitions
viestillä viestintäverkossa osapuolten välillä tai vapaasti valikoituville vastaanottajille välitettävää puhelua, sähköpostiviestiä, tekstiviestiä, puheviestiä ja muuta vastaavaa sanomaa;
message in telecommunications network either between parties or to freely selected receivers as phone, email, text message, voice message or any other similar message;
* So basicly, as also previously defined by current juristiction, a bulletin board system applies as a telecommunications service which provides message to which telecommunications privacy laws apply into.
Of course it's rather "grey area" as we indeed did grant him ourselfs access to board. Question is did he gain access with malicious intent and was a inteded receiver of the message he copied elsewhere.
Rikoslaki 19.12.1889/39" (criminal law, section 5) is sort of also, possibly, broken as we know for a fact, that he gave our teamspeak password to other people.
But overall, I have no wishes to pursuit the matter further and quite frankly do feel, that I was shooting a bee with a elephant gun.
